JUSTICE BISWAJIT PALIT Order 10/04/2026 This bail application is filed under Section 483(1)(b) of the BNSS for granting bail to the accused persons in custody namely, Smt. Rina Devi, Smt. Rinku Devi, Smt. Laxmi Devi and Smt. Gita Devi who are in custody on and from 19.02.2026. Heard Learned Counsel, Mr. Samar Das appearing for the accused persons in custody and Learned PP Mr. Raju Datta, appearing for the respondent. It is submitted that the accused persons are women and they were supposed to surrender before the Ld. Trial Court on 20.12.2025 but as they failed, so warrant of arrest was issued and thereafter they surrendered before the Ld. Trial Court on 19.02.2026 and since then they are languishing in jail. Learned PP at this stage submitted that by order dated 26.09.2025 they were granted interim bail till 20.12.2025 with certain conditions but they failed to comply with the order of the court and even they did not surrender before Ld. Trial Court on 20.12.2025 which shows the conduct of the accused persons. 2 Learned PP further submitted that by this time the IO has laid charge-sheet but there is no indication in the record whether the charge-sheet has been submitted or not. The conduct was not at all satisfactory. However, considering the fact that the accused persons are women and are languishing in jail since 19.02.2026, I am inclined to release them on bail of their furnishing bail bond of Rs.1,00,000/- each with one surety who must be a public servant with condition that they shall attend court once in every week till completion of the trial, in default they shall remain in J/C as before. Send down the record to the Learned Trial Court along with a copy of this order. Supply a copy of this order to IO through Learned PP for information. However, in future, if the accused persons again commits the same conduct in that case appropriate order will be passed in due course of time for holding their trial keeping them in custody.
