The present writ petition has been filed under Article 226 of the Constitution of India, seeking a writ of mandamus directing respondent nos. 1 to 3 to provide immediate police protection to the petitioner and her husband, to take appropriate action on her complaint dated 25.03.2026, and to restrain respondent nos. 4 to 7 from causing any harm to the petitioner and her husband. 2. As per the case set up by the petitioner, she is a permanent resident of Village Tadapur, Panchayat Sanaiya, Police Station Aryari, District Shekhpura, Bihar, and is presently residing with her husband, Sh. Amarjeet, in Uttam Nagar, Delhi. It is averred that the petitioner and Sh. Amarjeet were in a relationship for approximately two years, and upon respondent nos. 4 to 7, being the parents and other family members of the petitioner, This is a digitally signed order. It is further averred that on the petitioner’s refusal, her father allegedly assaulted her, causing grievous injuries. 3. It is the case of the petitioner that on account of the aforesaid coercion and threats, the petitioner and Sh. Amarjeet solemnized their marriage on 23.02.2026 according to Hindu rites and customs at the Sanatan Vedic Samaj Kalyan Sanstha, New Sanjay Amar Colony, Delhi, out of their own free will and without any pressure, force or threat from any quarter. 4. It is further averred that upon respondent nos. 4 to 7 learning of the said marriage, they began threatening the petitioner and her husband with dire consequences, including an incident dated 27.02.2026, whereby certain unidentified persons are alleged to have forcibly restrained the petitioner and her husband near Uttam Nagar Park, Delhi. It is also averred that commencing 16.03.2026, the petitioner and her husband began receiving calls from a person identifying herself as one Ms. Pratima Kumari, purportedly an Investigating Officer attached to Police Station Aryari, District Shekhpura, who allegedly threatened the petitioner with false implication and fake encounter unless she returned to Bihar with her husband. It is further averred that a subsequent attempt by the petitioner and her husband to meet the said Investigating Officer on 19.03.2026 did not materialise, and that a second incident of alleged wrongful restraint occurred on 22.03.2026 near Uttam Nagar Park. 5. It is averred that the petitioner lodged a complaint dated 25.03.2026 before the SHO, Police Station Uttam Nagar, the DCP (West), and the SHO, Police Station Aryari, District Shekhpura, but no action was taken This is a digitally signed order. As per the status report, upon enquiry, the petitioner stated that she is residing with her husband at the aforesaid address in Uttam Nagar in a rented accommodation, and that she had voluntarily left Bihar with Sh. Amarjeet Kumar, who is a resident of her native village, and that both of them solemnised their marriage at Delhi on 23.02.2026 out of their own free will. It is recorded that the petitioner stated that although her family members have allegedly been harassing her husband’s family in Bihar, neither she nor her husband has received any phone calls, threats or any form of direct harassment from her family members. The petitioner requested that her family members be restrained from unnecessarily harassing her husband’s family, as she and her husband are presently residing peacefully in Delhi. 7. The status report further records that Sh. Amarjeet Kumar, upon enquiry, corroborated the petitioner’s statement, and stated that he resides at the aforesaid Uttam Nagar address and is employed as a delivery executive, and that he too has not received any phone calls or threats from the petitioner’s family members for the last several days. 8. It is further recorded in the status report that notices were issued to respondent nos. 4 to 7 requiring them to join the enquiry; however, none of them has appeared or joined the enquiry till date. A notice was also issued to the Sanatan Vedic Samaj Kalyan Sanstha for verification of the marriage certificate and connected documents, including proof of age of the parties and identity proofs of the witnesses, and the said institution has furnished the requisite documents, which have been taken on record. 9. The Order is downloaded from the DHC Server on 13/08/2026 at 11:46:30 petitioner has already been provided with the contact numbers of the Beat Staff, the Duty Officer and the SHO of Police Station Uttam Nagar, and has been advised that in the event any difficulty arises in Bihar, she may approach the concerned police station in District Shekhpura and lodge an appropriate complaint. It is further recorded that the Enquiry Officer at Bihar has also been duly informed through coordination between the local police and the Bihar Police. 10. Having perused the record, this Court notes that as per the categorical statements recorded by the enquiry officer, both the petitioner and her husband have, on enquiry, stated that they are presently residing peacefully in Delhi and are not facing any direct harassment, threat or telephonic calls from the petitioner’s family members. The apprehension voiced in the petition, therefore, stands substantially addressed insofar as the present factual position is concerned, though the possibility of the petitioner requiring protection in the future cannot be ruled out. 11. In view of the aforesaid, and considering that the local police has already put in place a mechanism by furnishing the contact details of the Beat Staff, the Duty Officer and the SHO, Police Station Uttam Nagar, to the petitioner, this Court is of the view that no further direction is warranted at this stage, save and except granting liberty to the petitioner to seek recourse to the said mechanism as and when required. 12. The petitioner is granted liberty to approach the concerned Beat Officer/Inspector of Police Station Uttam Nagar in case she perceives any threat to her life or liberty, or that of her husband. 13. If the petitioner does so, let the concerned Beat Officer/Inspector take appropriate steps in accordance with law, expeditiously. This is a digitally signed order.
