Rakib (rejected) CRM (NDPS) 20 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bashirhat Police Station case no. 476 of 2025 dated 31.05.2025 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Abdul Hakim Mondal @ Hakim ……Petitioner. Ms. Malashree Ghosh ……for the Petitioner. Mr. Madhusudan Sur, Ld. APP Mr. Atif Ahmed Siddiqui ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 145 days and has been falsely implicated only on the basis of statement of co-accused. According to the learned advocate for the petitioner, petitioner has been shown arrested in connection with the instant case. Learned advocate for the State on the other hand opposes the prayer for bail and submits that the case number which has been drafted in the Cause Title would relate to Bashirhat Police Station case no. 476 of 2025 and not Swarupnagar Police Station Bashirhat FIR no. 476 of 2025. Learned advocate for the State has advanced the certified copy of the order-sheets of the learned Additional District and Sessions Judge, 8th Court, Barasat, 24 Parganas North. I have taken into account the factum of recovery of 2000 bottles of phensedyl in connection with the instant case and 2 the petitioner is having antecedents, although, it has been claimed that there has been no recovery from the petitioner. Be that as it may, that charge-sheet has already been submitted, I am of the view petitioner would be better advised to approach this Court after the evidence of the seizure list witnesses are over. At this Stage, CRM (NDPS) 20 of 2026 is dismissed. Report so submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
