JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner – husband is before this Court calling in question proceedings in C.C.No.970/2022, pending before the 7th Additional Senior Civil Judge (Sr. Dn.) and CJM, Mysuru, for the offences punishable under Sections 498A, 504 and 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. - 3 - HC-KAR NC: 2026:KHC:10756 WP No. 22135 of 2023 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking permission to compound the offences. The parties have filed an application in I.A.No.1/2026 under Section 320 of the Cr.P.C., and an affidavit of the complainant before this Court to that effect. 3. The application reads as follows: “4. Under the terms of dissolution petitioner as filed alimony sum of rupees 10,00,000/- (ten lakhs rupees) by way of demand draft in favour of respondent no.2 as full and final settlement in DD No."519817", drawn in the State Bank of India, Kuvempunagar Branch, Mysore date.23.01.2026, the respondent no.2 has received the demand draft and encashed the same and acknowledged. 5. the respondent no.2 has no objections to quash the above Crime in FIR No.0002/2022 and C.C.No.970/2022 namely Annexure – A B C D. 6. As for the terms of compromise the respondent shall give consent for closure of all the criminal pending cases in crime No.0002/2022, C.C No.970/2022, which is the present case. 7. The respondent no.2 shall give consent for quashing in W.P No.22135/2023, W.P no.4093/2023 before this Hon'ble court and Respondent no.2 shall withdraw M.F.A No.4496/2023.” - 4 - HC-KAR NC: 2026:KHC:10756 WP No. 22135 of 2023 In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the application and terminate the proceedings against the petitioner, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The writ petition is disposed.
