THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 594/2026 ORDER:
This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, “BNSS”), by the petitioner/Accused No.1 and 2 seeking grant of pre-arrest bail in connection with Cr.No. 157/2025 of Tirupati West Police Station, Tirupati District, registered for the offences punishable under Sections 318 (4), 351 (2) r/w 3 (5) BNS, Section 4 of PC & MCSBA, Section 5 of APPDFEA. 2. The case of the prosecution, in brief, is that prior to 06.11.2025, at Door No.3-6-163, Katikarangadi Street, Tirupati Urban, Tirupati District, the accused A-1 Molalamma @ Mounika, A-2 Subba Reddy (husband of A-1), A-3 G. Sukumar (son of A-1) and A-4 Suchithra (daughter of A-1), allegedly ran private chit schemes without obtaining any valid licence and induced the de-facto complainant along with other members, to join various chit groups floated by them; believing their representations, the complainant and others paid the installments regularly, but after completion of the chit period, the accused failed to disburse the matured chit amounts and kept postponing payment on one pretext or the other, and when questioned, they allegedly threatened the complainant and other members claiming political influence and rowdy support, thereby
4
cheating the complainant and other chit subscribers to the tune of approximately Rs.1,61,50,000/- by dishonestly collecting and misappropriating the subscription amounts for wrongful gain. 3.
3. Considering the facts and circumstances, since, there is no change of circumstances and in the light of the specific overt-acts attributed against the petitioner, this Court is not inclined to grant pre- arrest bail to the Petitioner/ Accused . 4. At this juncture, learned counsel for the petitioner would submit that the petition may be disposed of by granting liberty to the petitioners to surrender before the learned Jurisdictional Magistrate and to move a regular bail application, and that a direction may be issued to dispose of the said application as expeditiously as possible. 5. The learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 6. Accordingly, the Criminal Petition is dismissed. However, the petitioner/Accused No.1 and 2 are at liberty to surrender before the concerned Court within a period of one (01) week from the date of receipt of a copy of this order and move an appropriate application seeking regular bail. Upon such application being filed, the learned jurisdictional Court shall consider and dispose of the same on its own
