The present petition under Section 11(6) of the Arbitration and Conciliation Act, 19961 is being preferred to appoint Sole Arbitrator for the disputes arising between the parties in terms of arbitration Clause 9 of the Work Order dated 16.06.2022 for providing webcasting, live streaming (audio and video) and recording services during the bye-election 2022 of AC-39, Rajinder Nagar, New Delhi. 2. Clause 9 of the aforesaid Work Order reads as under: Arbitration Clause:- In the event of any question, dispute or differences arising between the parties relating to the interpretation and application of the provision of this agreement, such disputes for differences shall be 1 “Act” hereinafter Signed By:ANUBHAV TRIPATHI Signing Date:21.08.2026 19:32:27 Signature Not Verified ARB.P. 1046/2026 resolved amicably with the mutual consultations and on failure to do so shall be referred for arbitration. The decision of the arbitrator to the agreement in this regard shall be final and binding upon both the parties. The parties shall continue to perform their obligation under this agreement during arbitration proceedings. The location for arbitration will be within NCT of Delhi. Arbitration procedure will be as per Indian Arbitration and conciliation Act, 1996. Further, the power to appoint an arbitrator vests with Lt. Governor of Delhi. Any dispute shall be subject to exclusive jurisdiction of Delhi Courts. 3. It is the Petitioner’s case that it acted in furtherance of the said Work Order, completed its contractual obligations and accordingly raised an invoice towards the services so rendered. 4. According to the Petitioner, despite several attempts, the Respondents have defaulted in payment. Hence, the present petition. 5. Mr. Abhinav Sharma appeared for the Respondents today and submitted that he has no objection for the appointment of the Sole Arbitrator. 6. It is well settled that, while exercising jurisdiction under Section 11 of the Act, the scope of enquiry is confined to examining the prima facie existence of an arbitration agreement2. 7. There is no dispute as far as this arbitration clause is concerned and the parties are ad idem with respect to the reference of the disputes to arbitration. The claim amount is stated to be Rs. 39,52,036/-. 9. Accordingly, Mr. Nikhil Aradhe, Advocate (Mob. No. +91- 9406712068) is appointed as a learned Sole Arbitrator to adjudicate the disputes arising out of the Work Order/Contract Agreement dated 16.06.2022 executed between the parties. 10. The learned Sole Arbitrator shall enter upon the reference within two weeks from today. 11. The learned Sole Arbitrator will proceed to the arbitration proceedings subject to furnishing requisite disclosures as required under Section 12(2) of the Act within two weeks of entering reference. 12. The arbitration shall be carried under the rules and aegis of Delhi International Arbitration Centre (“DIAC”). The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 13. It shall be open to the parties to raise all pleas, including objection as to arbitrability and jurisdiction, before the learned Sole Arbitrator who shall decide the same in accordance with law. 14. It is clarified that the observations made herein are only for the purpose of deciding the present petition under Section 11(6) of the Act.
