This is a petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as “the Act”) for appointment of an arbitrator. 2. It is not disputed that this Court vide order dated 01.11.2023 in ARB. P. 1219/2022 had appointed an arbitrator to arbitrate the disputes between the parties. 3. Consequently, the arbitrator had entered reference and commenced the arbitration proceedings. While the arbitration proceedings were pending, vide order dated 09.05.2025, the learned arbitrator, for personal reasons recused himself from this arbitration and requested that the file be sent to Delhi International Arbitration Centre for further necessary action. 4. Though this arbitration petition has been styled as one under Section 11(6) of the Act, however, according to the Court, it ought to have been filed This is a digitally signed order. Accordingly, and in exercise of the jurisdiction under Section 15(2) of the Act, this Court appoints Mr. Santosh Snehi Mann, DHJS (Retired Judge), Mobile No.9910384743 as an Arbitrator. The fees of the arbitrator shall be governed under Schedule IV of the Arbitration and Conciliation (Amendment) Act, 2015. The proceedings shall be carried out under the aegis of the Delhi International Arbitration Centre. 6. Let the copy of this order be sent to the Delhi International Arbitration Centre forthwith. 7. It is also made clear that the proceedings shall recommence from the stage at which it was last pending before the arbitrator on 09.05.2025. It appears from the reading of the order dated 09.05.2025 that the cross examination of CW-1 was pending. It is made clear that the CW-1 shall offer himself for cross examination on the first available opportunity as and when the date is fixed by the arbitrator for such purpose. 8.
