Having considered submissions of learned counsel for the peoners, though this Court finds that there is no illegality or perversity in the impugned order as the defendants-peoners had put in appearance before the Court on 07.07.2023 and the defence was struck off on 09.09.2024 a=er providing more than sufficient opportunies, but considering the fact that valuable rights of the peoners are involved and even the plainff-respondent has not started leading evidence, the trial Court is directed to provide one opportunity to the peoners-defendants to file the wri;en statement subject to ₹20,000/- as cost payable to the respondent-plainff by way of a Demand Dra=. The payment of the said cost shall be condion precedent. Next date of hearing is stated to be 24.04.2026.
