For Petitioner: Mr.M.Dinesh For Respondents: Mr.D.Ravichander, Special Government Pleader for R1 to 5 Notice dispensed with for R6 ORDER This writ petition has been filed, challenging the impugned order dated 03.08.2025 passed by the fifth respondent under which the petitioner’s patta for the property, morefully disclosed in the prayer to this writ petition has been cancelled. 2.Admittedly, the petitioner has already filed a Civil Suit seeking for declaration that the petitioner is the absolute owner of the property, morefully disclosed in the prayer to this writ petition. The said Civil Suit is pending on the file of the District Munsif Court, Attur in O.S. No.358 of 2011. The patta issued in favour of the petitioner has been cancelled by the fifth respondent under the impugned order dated 03.08.2025 on the ground that a Civil Suit is pending. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 5. https://www.mhc.tn.gov.in/judis WP No. 7059 of 2026 4.This Court does not find any infirmity in the reasoning given by the fifth respondent for cancelling the petitioner’s patta. However, in case the petitioner apprehends that the sixth respondent may alienate/encumber the property, morefully disclosed in the prayer to this writ petition, the petitioner must be granted liberty to approach the Civil Court in O.S. No.358 of 2011 on the file of the District Munsif Court, Attur by filing an I.A. seeking for an interim injunction to restrain the sixth respondent from alienating/encumbering the property. 5.For the foregoing reasons, since the petitioner has already filed a Civil Suit seeking for declaration of her ownership, this writ petition is disposed of by granting liberty to the petitioner to approach the Civil Court in O.S. No.358 of 2011 on the file of the District Munsif Court, Attur seeking for an interim injunction to restrain the sixth respondent from alienating/encumbering the property, morefully disclosed in the prayer to this writ petition. The Civil Court shall consider the said application, on merits and in accordance with law as expeditiously as possible. Consequently, connected WMPs are closed.
