JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed assailing the award dated 23.06.2015 in Reference No.45/2014 by the Presiding Officer, II Additional Labour Court, Bengaluru. 2. The said award was ex parte award and an application in Misc.No.4/2015 is filed to recall the ex parte award, which also came to be rejected vide order dated 28.01.2017 and the said order is also called in question in this petition. 3. Learned counsel for petitioner-Establishment and the respondent-workman are present before this Court. 4. Learned counsels for parties jointly submit that the dispute is amicably settled. The joint memo is signed by the petitioner as well as the respondent. The respondent has agreed to receive ₹3,00,000/- towards his full claim against the petitioner. - 3 - HC-KAR NC: 2026:KHC:7937 WP No. 16066 of 2017 5. The terms and conditions of the joint memo reads as under:- “Pursuant to discussions held between both parties along with their respective Counsels, this settlement is entered into on the following terms: Terms of Settlement 01. The Petitioner Management has on this day paid a sum of Rs.3,00,000/- by cheque No.009462 dated 10/03/2026 drawn on AXIS Bank, Bommasandra Brura KT Bengaluru Rural branch, in favor of Respondent Mr S.B. Krishna in full and final settlement towards back- wages from 07/09/2013 till 01/12/2017 (alleged date of refusal of employment and reinstatement). 02. The Respondent workman Mr S.B.Krishna who is present before this Hon’ble Court on being identified by the petitioner herein receives in said cheque for Rs.3,00,000/- by cheque No.009462 dated 10/03/2026 drawn on AXIS Bank, Bommasandra Brura KT Bengaluru Rural branch,- in his favor of in full and final settlement towards back-wages from 07/09/2013 till 01/12/2017 (alleged date of refusal of employment and reinstatement). 03. In view of this settlement, the Respondent shall not be entitled / eligible to any other amount towards back-wages and/or other legal dues which includes any other consequential benefits including leave wages, bonus and other allowances if any as per the terms and - 4 - HC-KAR NC: 2026:KHC:7937 WP No. 16066 of 2017 conditions of employment that prevailed at the relevant point in time, except continuity of service. 04. In view of this settlement, both parties humbly pray this Hon’ble Court to substitute this settlement with Award Annexure-E dated 23/06/2015 passed by 2nd Additional Labour Court, Bengaluru in Reference No.45/2014. This settlement is signed on this Tenth day of February, Two Thousand Twenty Six (10/02/2026) at Bengaluru.” 6. This Court does not find any impediment to accept the terms and conditions of the joint memo. 7. The impugned award and the order are set aside in terms of the settlement arrived at between the parties. The writ petition is accordingly disposed of.
