Shukla, A.P.P. ------ 05/ 08.06.2026 Heard learned counsel for the petitioners and learned A.P.P for the State. 2. The petitioners are apprehending their arrest in connection with Dumri P.S. Case No. 02 of 2026, registered for the offence under Section 108 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that the marriage of petitioner No. 1 was fixed with one Savitri Kumari. He next submits that one Vishal Singh was in love with the said girl, however, the said girl was not in love with said Vishal Singh. He next submits that due to that reason, Vishal Singh used to threaten the said girl by way of saying that he will get the marriage broken with the petitioner No. 1 for that the petitioner No. 1 has warned the said Vishal Singh not to disturb the said girl and due to that said Vishal Singh has committed suicide. He next submits that so far as petitioner No. 2 is [ 2026:JHHC:16266] -2- concerned, there is no allegation against him. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioners. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the boy, who has committed suicide, was in one-sided love with the said girl, whose marriage has been fixed with petitioner No. 1. 5. From the FIR, it transpires that the girl was not in love with said Vishal Singh, however, he used to talk and threaten the girl and subsequently, he has committed suicide and how the petitioner Nos. 1 and 2 are responsible for instigating the deceased Vishal Singh for committing suicide is not clear from the FIR. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Dumri P.S.
