Heard Sri Dhirendra Srivastava, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the elections conducted by the Bar Association, Maitha despite the restraint order passed by U.P. Bar Council on 09.09.2026 in which the date was fixed for the disposal of matter of complaint. In such above view of the matter, we find it appropriate for the petitioner to either question the elections before the Deputy Registrar Societies for it being in violation of Model Bylaws or otherwise pursue the matter before the U.P. Bar Council who is required to register the office bearers in view of the judgment of Division Bench in the case of Chandrashekhar Upadhyay, Advocate v. State of U.P. & 8 Others, Writ - C No. 6613 of 2026 decided on 20.05.2026. In so far as the complaint of Bar Council of Uttar Pradesh is concerned, we however further provide that in the event petitioner approaches the Bar Council of Uttar Pradesh for registering his complaint regarding alleged illegal elections of Bar Association, Maitha, the Bar Council of Uttar Pradesh shall examine the matter before finally registering the list of office bearers of the Bar Association.
