BEFORE HONOURABLE MR. JUSTICE ARUN DEV CHOUDHURY
ORDER Date : 05.10.2026
1. Heard Mr. J Islam, learned counsel for the petitioner.
2. The case of the petitioner is that the petitioner has been elected as a Ward Member from 80/4 Kathaldi Pt.II (Kha) constituency under 80-Kajaikata Gaon Panchayat of Dhubri district in the Panchayat General Election held on 07.05.2025. Within the petitioner’s Gaon Panchayat ward area, there are three Anganwadi Centres, namely, (i) 121 No. Dakhinpara Anganwadi Centre; (ii) 60 No. Goalerchar Model Anganwadi Centre; (iii) 148 No. Gourang River Eastside Katakhal Mini Anganwadi Centre.
3. According to the petitioner, the Women & Child Development Department, Govt. of Assam, by a notification dated 21.05.2025, has issued guidelines for constitution and functioning of the Anganwadi Centre Management Committee. As per Clause 1 (i), the Gaon Panchayat Member representing the area where the Anganwadi Centre is located shall be the Ex-officio Chairman of the

4. It is the case of the petitioner that insofar as the first Anganwadi Centre is concerned, she has been made the Chairperson. A proposal for the petitioner’s chairmanship for the second Anganwadi Centre has been forwarded, which is yet to be approved by the respondent No.4. However, the respondent No.5, according to the petitioner, has been illegally made the Chairperson in the Anganwadi Centre Management Committee in respect of the third Anganwadi Centre.
5. However, when the matter is listed today, Mr. J Islam,
learned counsel for the petitioner fairly submits that the notification dated 21.05.2025 has in the meantime been superseded by a Notification issued in the month of September, 2026 and therefore, nothing survives for the present, to be adjudicated in the present writ petition.
6. Accordingly, he submits that he may be allowed to withdraw this writ petition with a liberty to approach this court, if fresh cause of action arises.
7. Prayer stands allowed.
8. Accordingly the writ petition stands dismissed on withdrawal with liberty as prayed for.
