By virtue of the present bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in FIR No.1060/2023 dated 30.11.2023 registered at PS: Wazirabad under Sections 336/387/467/471/506/120-B/34/174-A of the Indian Penal Code, 1860 read with Sections 25/27/54/59 of the Arms Act,
1959. 2. Briefly put, as per prosecution, on 30.11.2023, the complainant Gaurav Tyagi reported that unknown persons had fired at the main gate of his residence. On inspection, a note was recovered near the said gate, wherein demand of a sum of Rs.50 lakhs was made and threats were This is a digitally signed order. extended to the complainant on behalf of the members of one Gogi Gang. The complainant thereafter again received threatening messages on WhatsApp. During investigation, two juveniles were apprehended, who disclosed the involvement of Manmohan @ Gaurav and Manish @ Sunny Kakran operating from Tihar Jail. Pursuant thereto, several other accused persons were also arrested. 3. Insofar as the present applicant is concerned, during investigation, it was revealed that the aforesaid WhatsApp messages were sent using a mobile number registered at Dubai, whose internet usage was traced to an Airtel number registered in the name of one Nitin. Technical surveillance established that the said Airtel number was being used by the present applicant. Further, the Dubai SIM cards, mobile phone and the said Airtel SIM were also recovered from him. 4. In these facts, this Court has heard learned counsel for the applicant as also learned APP for the State, who has handed over the Status Report which is taken on record. This Court has also gone through the documents and pleadings on record. 5.
The facts disclose that the applicant is neither named in the FIR nor is there a direct allegation made against him, and based on investigation, the only role assigned to him is primarily based on the technical evidence, since he was using the Airtel mobile number for operating the WhatsApp account from which the threatening messages were sent. Significantly, the said Airtel number is also not registered in the name of the applicant. Moreover, as per the Charge Sheet, there is a discrepancy in the IP Addresses as well. 6. remained in judicial custody for approximately two years and eight months, wherein his overall conduct, as per Nominal Roll, is ‘Satisfactory’ and the proceedings before the learned Trial Court is still at the stage of framing of charges, and as such the trial is unlikely to conclude in the near future, even though this Court is conscious of the seriousness of the offence involved but at this stage proceeding to grant regular bail to the applicant under the facts and circumstances involved. 7.

Accordingly, the applicant be released on regular bail in FIR No.1060/2023 dated 30.11.2023 registered at PS: Wazirabad under Sections 336/387/467/471/506/120-B/34/174-A of the Indian Penal Code, 1860 read with Sections 25/27/54/59 of the Arms Act, 1959, subject to him furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) along with one surety of the like amount by a family member/ friend having no criminal case pending against him and subject to the satisfaction of the learned Trial Court, and further subject to the following conditions: i. Since the applicant is a resident beyond the jurisdiction of this Court, he shall reside within the precincts of the local Police Station as mentioned in the TCR. ii. Applicant shall surrender his Passport, if any, to the IO within three days of his release. iii. Applicant shall join and participate in the investigation as and when called by the IO. iv. Applicant shall provide all his mobile numbers to the IO concerned which shall be kept in working condition at all times. v. not contact any of the prosecution witnesses, or tamper with the evidence of the case. 8. A copy of this order be sent to the learned Trial Court and concerned Jail Superintendent for necessary information and compliance. 9. Needless to say, expression of view(s) on the merits, if any, are solely for the purposes of adjudication of the present application and shall have no bearing on the overall case/ trial involved.
