Learned counsel appearing for the informant submits that she has received the vakalatnama on behalf of the informant today itself, however, the same has not been filed before the Registry.
2.
Let the vakalatnama of the informant be taken on record.
3.
Heard learned counsel for the petitioner, learned A.P.P for the State and learned counsel appearing for the informant.
4.
The petitioner is apprehending his arrest in connection with Satgawan P.S. Case No. 109 of 2025, registered for the offence under Sections 316(2), 318(2), 336(3), 338, 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Koderma.
5.

the informant. On these grounds, she submits that anticipatory bail may kindly be provided to the petitioner.
6.
Learned counsel appearing for the informant submits that now the entire money has been received by the informant. She submits that the informant is present in the court and she has been instructed to submit so. Learned A.P.P. appearing for the State has opposed the prayer and submits that the case is arising out of a money transaction.

There is no doubt that earlier the prayer for anticipatory bail of this petitioner was rejected by this court, however, it is well settled that in the changed circumstance, the second anticipatory bail application can be maintained. Since the case is arising out of money transaction and the entire money has been returned by the petitioner to the informant and that has been admitted by the learned counsel appearing for the informant and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner, above named.
9.
Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bond of Rs. 25,000/- (twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Koderma, in connection with Satgawan P.S.
