Case No. 334 of 2024 for the offence registered under Sections 281, 324(4) of the BNS read with Section 15(c), 25 of the NDPS Act pending in the Court of learned Sessions Judge, Ramgarh, is pressed into motion. As per the FIR, one trailer bearing registration no. PB 03AP 9945 met with an accident on 10.04.2024 and on receipt of the information, the police party reached there where it found that 28 plastic sacs loaded over the iron rods weighing 543.055 Kg. of poppy straw on the said trailer. Contraband was seized, owner-cum-driver of the trailer was Bal Karan Singh, was arrested on spot and the name of petitioner has come-up on the disclosure statement made by him. It is submitted by the learned counsel on behalf of petitioner that he has no concern with the contraband or the trailer. He was neither arrested at the place of occurrence nor anything has been seized from his conscious physical possession. He has been implicated in this case only on suspicion and confessional statement made by the co-accused before the police, which has got no evidentiary value. Further, he has no criminal antecedent so far as NDPS case is concerned. Learned P.P. has opposed the bail petition. It is submitted that the consignment of contraband (Doda) was dispatched by this petitioner and he was accompanying the contraband which has been established on the basis of the call details report of the mobile seized from him. His tower location of 2026:JHHC:62 the mobile phone establishes that he was all along following the vehicle in a separate vehicle and was in constant touch with the owner of the truck. Considering the submissions advanced on behalf of the State, I do not find it a fit case for grant of bail in view of Section 37 of the NDPS Act.
