The petitioner is an accused in connection with POSCO Case No. 03/2025, arising out of Murhu P.S. Case No.56/2024. The informant was subjected to gang rape by the accused persons. It has been submitted by learned counsel for the petitioner that the one of the co-accused- Naman Bodra who is said to have committed rape upon the victim has been granted bail in B.A. No.11750/2025. Learned counsel submits that the petitioner has been identified by the victim in the Test Identification Parade as one of the persons who was standing at the place of occurrence. Learned counsel by referring to the evidence of the victim, who has been examined as PW-I, has stated that she does not remember the face of the persons who had committed rape upon her since it was dark. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner. Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned District & Additional Sessions Judge-1st cum-Special Judge, POCSO Act, Khunti, in connection with POSCO Case No. 03/2025, arising out of Murhu P.S. Case No.56/2024, subject to the condition that the petitioner shall physically present before the learned trial Court on each and every date, till the conclusion of the trial.
