Brief facts necessary for deciding the present petition are as follows:
3.1. The petitioner is a “generator company” within the meaning of Section 2(28) of the Electricity Act, 2003 and is engaged in the development of renewable energy generating stations. 3.2. The petitioner had made an application on 17th April, 2023 to the respondent no.1/Central Transmission Utility of India Ltd. (“CTUIL”) for the grant of 100 MW connectivity in respect of its proposed wind power project at Dhar, Madhya Pradesh. 3.3. The respondent no.1/CTUIL granted connectivity in favour of the petitioner vide communication dated 11th March, 2024. In terms of the prevalent advisory, at the relevant point of time, the project cost in respect of the wind power project was fixed at Rs.7 crore per MW of electricity generated, which was required to be achieved by the petitioner as part of the Financial Closure, the prescribed date for which was 30th June, 2026. 3.4. On 10th April, 2026, the aforesaid threshold was increased from Rs.7 crore per MW to Rs.8 crore per MW for purposes of connectivity. 3.5. The petitioner achieved Financial Closure on the basis of Rs.7 crore per MW and this was communicated to the respondent no.1/CTUIL vide email dated 7th May, 2026. However, the same was not acceptable to the respondent no.1/CTUIL on account of the increase in threshold from Rs.7 crore to Rs.8 crore. 3.6. Ultimately, the impugned communication dated 14th August, 2026 was issued by the respondent no.1/CTUIL threatening to revoke the connectivity and invoke the bank guarantees furnished by the petitioner. 4. Aggrieved by the aforesaid, the present writ petition has been filed. 5. Without prejudice to the rights and contentions of the petitioner, it is submitted that the petitioner is willing to comply with the current threshold of Rs.8 crore per MW to achieve financial closure and suitable time may be given for the same. 6. Mr.
Dayan Krishnan, senior counsel appearing on behalf of the petitioner, submits that the petitioner is in the process of filing a statutory petition before the respondent no.2/Central Electricity Regulatory Commission (“CERC”) and that one (1) week’s time be given for the same. 7. The Court is informed that the sitting of the CERC is scheduled on 27th August, 2026. 8. Issue Notice. 9. Notice is accepted by counsel appearing on behalf of the respondent no.1/CTUIL and the respondent no.2/CERC. 10.
