Sheoran, Advocate along with Petitioner Nos. 1 & 2. versus THE STATE NCT OF DELHI AND ORS .....Respondent Through: Mr. Rajkumar, APP for the State with SI Krishan Varma. Respondent No.2 through V.C. CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioners herein seek quashing of FIR No. 0156/2017 dated 03.07.2017, registered at P.S. Inder Puri, for commission of offences under Sections 324/354/452/506/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The abovesaid FIR was registered on the basis of complaint made by the respondent No.2 who was pursuing law at the relevant time. 3. According to her, on 02.07.2017, petitioner No.1 who is her neighbour had entered into her house and used abusing language and pushed her. He was confronting as to who had dared to park motorcycle in front of his house. He touched her inappropriately and on hearing her screams, when her brother (respondent No.3 herein) came for her rescue, even he was not spared. She also claimed that the other co-accused (brother of Kartik) also came there and indulged in the incident and assaulted her and her brother. 5. The case is already at the stage of recording of prosecution evidence. 6. However, in the interregnum, the matter has been amicably settled and quashing is being sought based on settlement deed dated 28.04.2026. 7. Respondent No.2 has joined the proceeding through video-conferencing and she has been duly identified by I.O. She is stated to be in Ujjain and reiterates the terms of the settlement and states that in order to ensure that there is requisite peace and harmony in the neighbourhood and with the intervention of elders and respectable members of the society, the matter has been amicably settled. She states that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and therefore, she would have ‘no objection’ if FIR in question is quashed. 8. Respondent No.3 is present in Court and he also reiterates the terms of the settlement. He is also a signatory to the abovesaid settlement. 9. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 11. Consequently, to secure the ends of justice, FIR No. 0156/2017 dated 03.07.2017, registered at P.S. Inder Puri, for commission of offences under Sections 324/354/452/506/34 IPC, along with all consequential proceedings Signed By:SONIA THAPLIYAL Signing Date:21.08.2026 11:13:49 CRL.M.C. 4612/2026 3 emanating therefrom, is hereby, quashed. 12. Original affidavits and MoU of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record. 13. The petition stands disposed of in aforesaid terms. 14. Pending applications also stand disposed of. (MANOJ JAIN) JUDGE AUGUST 19, 2026/ss/sk Signed By:SONIA THAPLIYAL Signing Date:21.08.2026 11:13:49
