IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT APPEAL NO: 73 of 2026 Bench Sr.No:-1 [3552]
Kamjula Venkata Rami Reddy and others ...Appellants Vs. The State of Andhra Pradesh and others ...Respondents
********** Advocate for Appellants: Mr. G. Jagadeeswar Advocates for Respondents: GP for Higher Education, Mr. Siva Kumar M (SC for RGUKT)
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 31st January, 2026.
P C :
The present Writ Appeal has been preferred against the judgment and
order dated 31.12.2025, passed in W.P.No.15597 of 2025. The Writ Petition was dismissed by the learned Single Judge on the ground that, since the dispute pertained to the occupation of a property which was in the possession of the petitioners and was neither a property belonging to the State nor an instrumentality of the State, the proper remedy would be to work out the remedies before a Civil Court.
2.
Learned counsel for the petitioners also appears to have undertaken to vacate the premises by 31.01.2026.
2 HCJ & CGRJ WA_73_2026
3. Be that as it may, we find no illegality in the order passed by the learned Single Judge, as the Writ Petition was certainly not maintainable against respondent Nos.2 and 3. In our opinion, the petitioners, having undertaken to vacate the premises and the Court having acted upon that undertaking, cannot be permitted to challenge the impugned judgment and order on other grounds.
4. In our opinion, no interference is warranted with the judgment and order impugned and the present Writ Appeal stands dismissed.
No costs. Pending miscellaneous application, if any, in this case, shall stand closed.
