Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The additional role of exhortation has been assigned to the applicant, but there are general and omnibus allegations against all the accused persons of having assaulted and caused injuries to three persons in all. It is further stated that two persons from the side of applicant have also sustained injuries in the alleged incident and an FIR No.195 of 2026 has been instituted at the police station though belatedly. 6. The FIR itself is delayed by about fifteen hours and there is no explanation of the said delay caused. The medical examination of two persons from the side of applicant was conducted prior to that of three injured persons in the instant case. Considering the facts and circumstances of the case, submissions made by learned counsel for the parties, the evidence on record, taking into consideration the delay in institution of FIR and also there being cross- version to the alleged incident, and without expressing any opinion on the merits of the case, prima-facie the Court is of the view that the applicant has made out a case for bail. The bail application is allowed. 9.
