Petitioner has filed this writ petition seeking following reliefs:- “1. That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of Mandamus commanding the respondents to produce the entire record leading to issuance of this Hon’ble Court. 2. That this Hon’ble Court may kindly be pleased to issue a Writ nature of certiorari quashing the impugned transfer order Annexure P-1. 3. That this Hon’ble Court may kindly be pleased to issue a Writ nature of mandamus directing the respondents not to relieve the petitioner from the present place of posting. 4.Any other relief that this Hon'ble Court may deem fit and proper may also be passed in favour of the petitioner.” 2. Learned counsel for petitioner submits that by the impugned order, the petitioner, who is posted as Senior Agriculture Development Officer at Block Lundra, Ambikapur, District Surgua, is posted in the office of Deputy Director, Department of Agriculture, Ambikapur, within a period of one year from his posting at present place. 3. Learned counsel for the State would submit that from the documents enclosed along with writ petition it is appearing that petitioner has not submitted representation before the Committee, headed by Senior Secretaries, constituted under the Transfer Policy to consider representation of employees against transfer. He submits that if petitioner is aggrieved by his transfer, he may submit representation before the Committee, which will 3 be considered in accordance with law. 4. At this stage, learned counsel for petitioner submits that this writ petition be disposed of permitting petitioner to submit representation before the Committee constituted under the Transfer Policy and in turn, the Committee may be directed to take decision on representation to be submitted by petitioner expeditiously within specific time frame. 5. Heard learned counsel for petitioner and perused the documents annexed with writ petition. 6. Considering the submission of learned counsel for parties and documents annexed along with writ petition, without entering into merits of claim of petitioner, writ petition is disposed of at this stage permitting petitioner to submit comprehensive representation against his transfer before the Committee constituted under the Transfer Policy, raising all the grounds as raised in this petition. On receipt of such representation, the Committee shall consider and decide it in accordance with law within '03 weeks' from the date of receipt of representation. 7. Till decision is taken on representation to be submitted by petitioner, status quo with respect to posting of petitioner, as it exists today, shall be maintained by the parties. 8.
