2/02.06.2026 Heard Mr. Ramesh Kumar, learned counsel for the petitioner and learned Spl.P.P. for the State.
The petitioner is apprehending his arrest in connection with Complaint Case No. 1806 of 2017.
It has been alleged that some miscreants were breaking stone inside the forest area and the tractor which was also standing in the said place was seized.
Submission has been advanced by the learned counsel for the petitioner that he has implicated only on the ground that he is the owner of the seized tractor. Learned counsel submits that the incident had taken place on 20.06.2017, and much prior to the said incident, the petitioner who had taken the tractor on loan was a defaulter and the tractor was ultimately seized by the bank officials and auction was made in favour of Shamim Ansari on 25.05.2016. Learned counsel submits that the petitioner does not have any criminal antecedent.
Learned Spl.P.P. has opposed the anticipatory bail of the petitioner
Regard being had to the fact that the tractor in question was already auctioned in favour of the Shamim Ansari much prior to the date of occurrence, I am inclined to extend the privilege of anticipatory bail to the petitioner.
Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Palamau in connection with complaint Case No.
2026:JHHC:16022 1806 of 2017, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
