Heard Mr. S. P. Sannat, learned counsel for the petitioners. Also heard Mr. Nitansh Kumar Jaiswal, learned Dy. Govt. Advocate, appearing appearing for the Respondent/State. 2. The present writ petition has been filed by the petitioners with the following prayers: "It is therefore, most humbly prayed that the Hon'ble Court may kindly be pleased to allow this petition and quash the FIR in crime no. 272/2023 registered in Polie station pamgad District - Janjgir- Champa (C.G.) under section 498 A read with section 34 of IPC and subsequent charge-sheet and criminal proceeding if arises, in the interest of justice." 3. Learned State counsel has pointed out that the petitioners have approached this Court seeking quashment of FIR bearing Crime No. 272/2023, registered at Police Station Pamgarh, District Janjgir-Champa (C.G.) for the offence punishable under Section 498-A read with Section 34 of IPC, along with the subsequent charge-sheet and criminal proceedings arising therefrom. However, it is not disputed that charges have already been framed against the petitioners on 09.04.2024 and the case is presently fixed for prosecution evidence, as is evident from the order- sheet of the trial Court. It is further noticed that the order framing charges has not been challenged by the petitioners. 4. On a pointed query made by this Court to the learned counsel for the petitioners as to why the order framing charges has not been challenged, learned counsel could not give any satisfactory explanation. 5. In view of the above, learned counsel for the petitioners seeks liberty to withdraw the present petition with liberty to file a fresh petition. 3 6. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by the petitioners in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Govt.
