JUDGMENT(ORAL) %
17.08.2026
1. The present petition has been filed under Section 29A(5) of the Arbitration and Conciliation Act, 19961 seeking extension of the mandate of the learned Arbitral Tribunal for a further period of 12 months w.e.f. 26.08.2026.
2. The arbitral proceedings arise out of an agreement dated 12.05.2016 executed between the parties for the balance work of the Main Plant Package at Barh STPP.
3. The arbitration was invoked by the Petitioner on 25.11.2023 and the first procedural hearing took place on 25.06.2024. Thereafter,
1 “the Act” hereinafter
O.M.P.(MISC.)(COMM.) 636/2026 p. 2 the learned Arbitral Tribunal was also reconstituted on account of the unfortunate demise of one of the members of the previously constituted Tribunal.
4. It is borne out from the record that, by mutual consent, the mandate of the learned Arbitral Tribunal was extended for a further period of six months, which is expiring on 26.08.2026.
5.
Learned Counsel for the Petitioner submits that the pleadings are completed and the proceedings are presently at the stage of cross- examination of the Respondent’s witness.
6. He further submits that the proceedings could not be concluded within the extended mandate despite the best efforts of the parties and seeks a further extension to allow the learned Arbitral Tribunal to conclude the proceedings.
7.
Learned Counsel for the Respondent has raised no objection and gave consent for extension of the mandate.
8. The power of this Court to extend the mandate of the Arbitral Tribunal under Section 29A of the Act is well-settled upon, where
“sufficient cause” is shown.
9. Having regard to the stage of the proceedings and the circumstances that the learned Tribunal was re-constituted, this Court is satisfied that the “sufficient cause” is made out for extension of the mandate.
O.M.P.(MISC.)(COMM.) 636/2026 p. 3 10. Accordingly, the mandate of the Arbitral Tribunal is extended by a further period of 12 months w.e.f. 26.08.2026 to conclude the arbitral proceedings and render the award.
11. The learned Arbitral Tribunal shall endeavour to conclude the proceedings within the extended period.
12. Accordingly, the present petition is disposed of as aforesaid.
