[2026:RJ-JP:2844] (2 of 5) [CRLMB-810/2026] jurisdiction of this Hon’ble Court. He also submits that the petitioner undertakes not to repeat offence and cooperate with trial, which will take time.
3.
Learned counsel for the petitioner submits that the first bail application of the present petitioner was dismissed on 25.09.2025 and now this is second bail application of the present petitioner. He further submits that in identical case, this Hon’ble Court has granted bail to Laaduram on
08.08.2025. He further referred order dated 09.10.2025 passed by this Court in case of Vijendra Kumar Joshi and submitted that he was also granted bail by this Hon’ble Court. He also referred order dated 16.12.2025 passed by a Co-ordinate Bench of this Court and submitted that on basis of bail order in case of Girdhariram Vs. State of Rajasthan (Petition for Special Leave to Appeal (Crl.) No(s). 7461/2025, Mahendra Kumar Vishnoi was granted bail. He also referred the facts of the cse and submitted that almost all accused were granted bail in PTI recruitment examination. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. He has also referred bail order dated 13.11.2025 in case of Deva Ram Vs. State of Rajasthan and submits that FSL report is against the petitioner and the allegations are of serious nature. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. [2026:RJ-JP:2844] (3 of 5) [CRLMB-810/2026]
6. On receipt of a written complaint that in PTI Direct Recruitment Examination, 2022, applicant-accused Suresh Vishnoi has not appeared himself but still he has been selected. After inquiry, the SOG has found that present applicant has not appeared as a candidate and he has been selected as some other person (impersonator) has appeared to help present applicant in said examination. After registration of case, SOG has found that present applicant has procured a job as PTI in Government School, District Jalour and arrested the present applicant on 09.06.2025. The SOG has found that applicant-accused has not appeared in the examination and in place of applicant-accused his brother Birbal has appeared as dummy candidate on behalf of applicant-accused. During investigation, SOG has also found that a fake degree of B.P.Ed was procured from JS University, Shikohabad (UP) against whom a case No. 13/2024 PS SOG was registered separately. The SOG has already filed charge-sheet against present applicant but kept pending against other persons. 7.
While considering the bail application on 25.09.2025, this Court has taken note of the order dated 08.08.2025 in case of Laaduram Vs. State of Rajasthan. This Court has also granted bail to Vijendra Kumar Joshi on 09.10.2025 in FIR No.10/2024 when the matter pertains to offence under the Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992, and the bail application of Aditya Upadhyay was allowed by Hon’ble Supreme Cout in Criminal Appeal No.4100/2025. A Co-ordinate Bench of this Court has
[2026:RJ-JP:2844] (4 of 5) [CRLMB-810/2026] granted bail to Mahendra Kumar Vishnoi (supra) on basis of bail order in case of Girdhariram Vs. State of Rajasthan (supra) passed by Hon’ble Supreme Court. 8. Here in this case, the allegations clearly indicate that the petitioner has applied for recruitment on the post of PTI and instead of appearing as a candidate, he engaged a dummy candidate and after passing the examination, the present petitioner was selected and got a job as PTI in Government Sr. Sec. School, Jalore. The allegation upon the petitioner is not only appearing through a dummy candidate in said recruitment but also submitting a fake and back dated degree. 9. In bail order dated 25.09.2025, this Court has considered all aspects. The case of the present petitioner is under the Rajasthan Public Examination (Use of Unfair Means) Act, 2022 and not under the Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992. 10. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far, this is not a fit case to enlarge the applicant accused on bail. 11. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage. [2026:RJ-JP:2844] (5 of 5) [CRLMB-810/2026]
12.
Accordingly, the 2nd application for bail filed under Section 483 of BNSS preferred by the petitioner-accused Suresh Vishnoi S/o Shri Ashuram Vishnoi is hereby dismissed. (ASHOK KUMAR JAIN),J MR/310
