JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a private criminal complaint in PCR No.54915/2025 on the file of the XXIX Additional Chief Judicial Magistrate, Bengaluru. 2. During the subsistence of the subject petition, the parties to the lis have entered into a settlement and filed a joint affidavit to that effect. 3. The joint affidavit reads as follows:- "JOINT AFFIDAVIT We, the Petitioner No.01, I, Lakshmamma, W/o Ashwathnarayan, D/o Munianjinappa, aged about 53 years, No.145, Near Gangamma Temple, Kariyanapalya, Near Hennur Main Road, Bengaluru- 560084 and the Respondent No.02, Prithviraj, S/o Dhayalan, Aged about 32 years, R/at #1, 1st Floor, OMBR Tele Phone Exchange, Banaswadi, Bengaluru- 560043 and also having his office at : Chokkanahalli Village, Jakkur Post, Yelahanka Hobli, Yelahanka - 4 - HC-KAR NC: 2026:KHC:11563 CRL.P No. 1000 of 2026 Taluk, Bengaluru - 560064, do hereby affirm and state on oath as under: 1. I, Lakshmamma, W/o Ashwathnarayan, D/o Munianjinappa state that, I am the Petitioner No.01 in the above case and as I know the facts of the case, I am competent to swear to this affidavit. I state that I am swearing to this affidavit on behalf of the Petitioner No.02 & 03. 2. We state that the averments made in the Memorandum of Petition may be treated as part and parcel of this affidavit in order to avoid brevity. 3. We state that the Petitioners have filed the above petition with a prayer to accept the above petition and pass appropriate orders or directions quashing the criminal proceedings in Crime No.0294/2025 and PCR No.54915/2025 against the Petitioners, compounding the offences initiated by the Respondent No.01, which is pending on the file of the XXIX Additional Chief Judicial Magistrate, Bengaluru. 4. We state that, we are willing to settle/compound the offences, and the Respondent No.2/Complainant shall - 5 - HC-KAR NC: 2026:KHC:11563 CRL.P No. 1000 of 2026 withdraw the allegation against all the Petitioners. Subsequently, to facilitate the said settlement the Petitioners and Respondent No.2 have amicably settled the dispute out of court on the advice of well- wishers. The Respondent No.2/Complainant is not ready and willing to proceed with the case against the Accused persons/Petitioners. 5. We state that, we both have agreed to co- operate with each other for quashing/closing of the FIR in Crime No.0294/2025 of Kothanur PS and FIR in Crime No.0302/2024 of Kothanur PS, which are the case and counter cases. And we both have agreed to cooperate with each other to quash the above said FIRs and proceedings on the same day before this Hon'ble Court. 6. We state that thereby we mutually agree that we have no claims, differences or enmity against each other. 7. We state that we both have settled all our differences and have decided close the dispute in a dignified manner without any friction or dispute between us and have opted for the final settlement lawfully. - 6 - HC-KAR NC: 2026:KHC:11563 CRL.P No. 1000 of 2026 8. We state that there is no coercion, fraud, undue influence or force from anybody upon us to file this affidavit and the Respondent No.2/Complainant willfully has given consent to quash the criminal proceedings in Crime No.0294/2025 and PCR No.54915/2025 against the Petitioners, compounding the offences initiated by the Respondent No.01, which is pending on the file of the XXIX Additional Chief Judicial magistrate, Bengaluru, against the Petitioners/Accused persons which was initiated by the Respondent No.2, which is the subject matter of this Criminal Petition. WHEREFORE, we humbly pray that this Hon'ble Court may be pleased to accept the joint affidavit and to allow the Interlocutory Application for compounding/settlement of the offences and allow the above-mentioned Criminal Petition to quash the criminal proceedings in Crime No.0294/2025 and PCR No.54915/2025 against the Petitioners, compounding the offences initiated by the Respondent No.01, which is pending on the file of the XXIX Additional Chief Judicial Magistrate, Bengaluru, in so far as the Petitioners herein are concerned." - 7 - HC-KAR NC: 2026:KHC:11563 CRL.P No. 1000 of 2026 4. The joint affidavit also recognizes the closure of the present proceedings. In the light of the joint affidavit, the proceedings against the petitioners are to be obliterated. 5. Hence, the following order is passed: ORDER (i) The petition stands disposed in terms of the joint affidavit. (ii) The proceedings in Crime No.294/2025 and PCR No.54915/2025 pending on the file of the XXIX Additional Chief Judicial Magistrate, Bengaluru, are quashed qua the petitioners.
