Petitioner Mr. Anit Dey …for the petitioner Mr. Soumik Ganguly Mr. Sachit Talukdar ..for the State Learned counsel appearing on behalf of the petitioner submits that there is no other material available against the petitioner except for the statements of the co-accused. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that the petitioner is the owner of the house from where the contraband was seized. He relies on the statements of local witnesses as well as the seizure list. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider that this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. (Jay Sengupta, J.)
