19.08.2026
1. Petitioner seeks setting aside of order dated 04.08.2026 passed by the Competent Authority, whereby the Minutes of Meeting of Sentence Review Board (SRB) dated 18.08.2026, so far as it relates to petitioner herein, have been approved.
2. Learned ASC for State appears on advance notice.
3. It is submitted that as per minutes dated 18.08.2026, SRB has declined premature release of the petitioner while relying on Delhi Police Report dated
27.12.2025.
4. It is, however, submitted that for the reasons best known to the Board, it did not consider the subsequent reports given by the Police. This is a digitally signed order. 5. Reference is made to report dated 07.01.2026 and 14.04.2026, which indicates that the police does not seem to have any objection on the premature release of the petitioner. Such reports have been given after requisite inquiry and feedback. Learned counsel for petitioner also refers to report dated 30.05.2026, given by the concerned Probation Officer, and as per such report also, the case of petitioner for his premature release has been recommended.
6. It is not amply clear as to why all these three reports were not even considered by the Board.
7.
Learned counsel for the petitioner, after some arguments and, without prejudice to his rights and contentions, restricts his prayer and submits that he would press for no relief, at the moment, if in the next Board meeting, the case of petitioner is considered afresh, while taking into consideration all such reports.
8. As would be evident, the last Board meeting was held on 18.06.2026.
9. Keeping in mind the overall facts of case and in view of the abovesaid statement made by learned counsel for the petitioner, the petition is disposed of with the direction that the case of the petitioner be placed in the next SRB meeting. This Court also expects that the Board would consider all the reports given by the Police and by the concerned Probation Officer and would take decision while also keeping in mind the specific observations given by this Court in Santosh Kumar Singh v. State (NCT of Delhi): 2025:DHC:5138.
10. A copy of this order be sent to Superintendent Jail for information and due compliance.
