Agarwal, Spl.P.P. --- Order No. 02/ Dated: 4th June, 2026 Heard Mr. Rishu Ranjan, learned counsel for the petitioners and learned Spl.P.P. 2. The petitioners are apprehending their arrest in connection with Kunda P.S. Case No. 01 of 2026. 3. The petitioners were suspected to be involved in poppy cultivation on forest land. 4. Submission has been advanced by learned counsel for the petitioners that several co-accused persons have been granted Anticipatory Bail in A.B.A. No. 2041 of 2026 and A.B.A. No. 1565 of 2026. 5. It has further been submitted that the petitioners do not have any criminal antecedent and there is absolute vagueness in so far as the identity of the petitioners are concerned. 6. Learned Spl.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners. 7. Regard being had to the fact that similarly situated co-accused have been granted Anticipatory Bail as noted above, I am inclined to extend the privilege of anticipatory bail to the petitioners. 8. Accordingly, the petitioners above named are directed to surrender in the court below within four weeks and pray for bail, and in that event, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge NDPS Cases, Chatra in connection with Kunda P.S. Case No. 01 of 2026, subject to the ( 2026:JHHC:16119 ) 2 conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. 9. This application stands allowed.
