Report in the form of affidavit on behalf of the respondent no.4 is filed. 2. Copy served upon the learned counsel for the petitioner. 3. On perusal of the said report, it appears that respondent no.4 has stated as follows: “the petitioner already had given statement that she has no any legal dues towards gratuity, SLT, bonus etc. of her deceased husband namely Lt. Harbans Pandit vide case no.217/G/2013.” 4. On perusal of the document annexed to the report, it appears that the petitioner herein has declared that on and from 29.04.2025, no legal dues towards gratuity, STL, bonus etc. in respect of her deceased husband is due to her and has accepted the amount as directed by the High Court in W.P.A. 23113 of 2024. Her son is the witness of the said receipt. 2 5. Now considering the said statement and documents filed and relying upon the provision of Section 4(5) of the Payment of Gratuity Act, the writ petition being not maintainable stands dismissed. 6. Certificate proceeding be accordingly closed on satisfaction. (Shampa Dutt (Paul), J.)
