L RANJITH KUMAR Counsel for the Respondent/complainant(S): 1. B.MADHU 2. PUBLIC PROSECUTOR 2 Dr.YLR, J Crl.P.No.564 of 2026 Dated 31.03.2026 The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioners/Accused No.1 in C.C.No.3285 of 2025 on the file of the learned Chief Judicial Magistrate, Visakhapatnam City registered for the alleged offences punishable under Sections 78 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) and Section 67-A of the Information Technology Act, 2000 (for brevity ‘the I.T. Act’). 2. Heard the learned counsel for the Petitioner, learned counsel for the 2nd respondent and the learned Assistant Public Prosecutor. Perused the record. 3. The respondent No.2 lodged a complaint with the Cyber Crime Police Station, Visakhapatnam City, which was registered as Crime No.321 of 2024 for the alleged offences punishable under Section 78 of ‘the BNS.,’ and Section 67-A of ‘the I.T.Act’. After thorough investigation, a charge sheet has been filed against the petitioner/Accused No.1 and another accused. 4. The learned counsel for the petitioner submits that he intends to confine the relief to dispensing with the personal appearance of the petitioner before the learned Trial Court. The learned counsel for respondent No.2 and the learned Assistant Public Prosecutor submit that the allegations are serious and that the investigation has clearly established the involvement of the petitioner in the alleged offences. Whether the petitioner/Accused No.1 has 3 Dr.YLR, J Crl.P.No.564 of 2026 Dated 31.03.2026 actually stalked respondent No.2 or not is a matter for trial, and this Court cannot undertake a mini trial at this stage. 5. The learned counsel for the petitioner further submits that the petitioner is working as an Assistant Manager, CCR Operator (CPP), at ACC Wadi Cements Area, Wadi, Kalaburagi District, Karnataka State, whereas the jurisdictional Magistrate is at Visakhapatnam. It has become highly difficult for the petitioner to undertake an arduous journey from Karnataka State to the northeastern part of Andhra Pradesh on every adjournment. 6. Since the learned counsel for the petitioner confines the relief sought, the Criminal Petition is disposed of by dispensing with the personal appearance of the petitioner, unless her presence is specifically required by the learned Magistrate. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
