POONACHA - 3 - HC-KAR NC: 2026:KHC:7558-DB WA No. 409 of 2026 ORAL JUDGMENT (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The appellants have filed the present appeal impugning an order dated 25.01.2026 passed by the learned Single Judge in Writ petition No.1094 of 2022 (EDN-RES). The appellants had preferred the said petition impugning the show cause notice dated 03.11.2021 praying that the same be declared as null, void and ineffective. The appellants had also impugned a final show cause notice dated 25.09.2020. The learned Single Judge had disposed of the writ petition by reserving the right of the appellants to reply to the show cause notice within a period of 15 days from the date of receipt of the copy of the order and in the meanwhile, the court directed the respondents not to take any coercive steps against the appellants. 2. The learned counsel appearing for the appellants submits that the show cause notice had been issued earlier and the appellants had replied to the same. He submits that the respondents had not considered the earlier replies furnished by the appellants and had issued fresh show cause notice. He contended that this pattern was repeating periodically. - 4 - HC-KAR NC: 2026:KHC:7558-DB WA No. 409 of 2026 3. In the event the appellants do not wish to reply to the said show cause notice, there is no compulsion for the appellants to do so. Since it is the appellants' contention that they had already responded to the allegations by furnishing their replies to the show cause notice issued earlier, we direct the respondents to consider the response furnished by the appellants to the earlier show cause notices as their response to the present show cause notice and take an appropriate decision, as the appellants do not wish to submit any further response other than what was submitted to the earlier show cause notices. 4. The respondents shall take a final decision with respect to the impugned show cause notices within a period of eight weeks from date. 5. Copy of this order be communicated to the respondents as well as the learned counsel who appeared for the respondents in the writ petition. 6. Meanwhile, the interim order passed by the learned Single Judge not to take any precipitate steps till the show cause notice is adjudicated shall continue to operate. - 5 - HC-KAR NC: 2026:KHC:7558-DB WA No. 409 of 2026 7.
