Diptendu Narayan Banerjee, …for the State. Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The private respondent is not represented despite service. The allegation of the petitioner is twofold. First, several complaints lodged against him on false and frivolous grounds have not been investigated. Second, the Investigating officer, the 5th respondent herein, has been pressurizing the petitioner to compromise the issues and is also not cooperating with the petitioner. The petitioner has lodged a complaint in this regard before the Deputy Commissioner of Police, Port Division, being the 4th respondent herein, on 25th September, 2024 which has not been considered. Learned counsel for the State denies and disputes the allegations made by the petitioner. Upon consideration of the submission made on behalf of the parties, this Court directs the police authority to conduct a fair and unbiased investigation with regard to 2 complaints pending before the police involving the petitioner and take the same to its logical conclusion, in accordance with law. The 4th respondent is directed to conduct an enquiry in terms of the allegations made in the complaint dated 25th September, 2024 and take necessary steps in accordance with law. Since no fruitful purpose shall be served in keeping the writ petition pending, the same is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
