The present writ petition has been filed by the petitioners with the following prayers: "10.1 Issue a Writ of Certiorari quashing the amendment notification dated 08.06.2023 (Annexure P-3), insofar as it introduces Clause (i) and (ii) in Rule 6, 5th row, which are vague, ambiguous and arbitrary. 10.2 Issue a Writ of Mandamus directing the respondents to declare the final select list for the post of Professor within a fixed time period, strictly on the basis of the original eligibility conditions contained in advertisement dated 08.09.2021 (Annexure P-1). 10.3 Issue a Writ of Prohibition restraining the respondents from giving effect to or acting upon the impugned amended eligibility criteria dated 08.06.2023. 10.4 Issue a Writ of Mandamus directing the respondents to formulate, publish, and notify a clear, unambiguous interpretation of Clause (i) and (ii) of Rule 6, 5th row, and to remove the ongoing confusion, ambiguity and administrative chaos created by the unclear use of "and/or" in the impugned amendment. 10.5 Any other writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. 3 10.6 Cost of the petition" 3. At the time of hearing, this Court observed that though respondent No.3 has been arrayed as a party respondent, a copy of the petition/application has not been served upon the learned advocate appearing for the said respondent. It is further noticed that the affidavit filed in support of the application seeking stay of the proceedings has also not been placed on record. 4. At this stage, learned counsel for the petitioners seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by the petitioners in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Govt.
