THIS PETITION, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER After addressing the arguments for sometime, a memo came to be filed which reads as under: ”The undersigned counsel for the petitioner herewith undertakes to pay a sum of Rs.1,50,000/- (Rupees one lakh fifty only) by end of the month June 2026. A sum of R.1,50,000/- (Rupees One Lakh Fifty Thousand only) already been deposited to the trial court. The abovesaid Rs.1,50,000/- shall be paid in the following manner. - Rs.25,000/- by the end of the month March (31.03.26) - Rs.25,000/- by the end of the month April- 2026(30.04.2026) - Rs.50,000/- by the end of the month May (31.05.2026) - Rs.50,000/- by the end of the month June (30.06.2026) May be taken on record in the interest of justice.” - 3 - HC-KAR NC: 2026:KHC:15255 CRL.RP No. 1280 of 2017 2. Sri S.V. Giridhar, learned counsel for the respondent/complainant has endorsed no objection. 3. Placing the memo on record, revision petition stands disposed of. 4. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 5. After payment of entire compensation amount as agreed in the memo, the fine amount of Rs.5,000/- imposed by learned Trial Magistrate, confirmed by the First Appellate Court towards defraying expenses of the State stands set aside. 6. If there is default in payment of any one of the instalments as agreed in the memo, the order of sentence of imprisonment passed by the learned Trial Magistrate, confirmed by the First Appellate Court stand restored automatically.
