The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) read with Article 227 of the Constitution of India, seeking quashing of FIR No. 508/2019, registered at Police Station Harsh Vihar, for the offences punishable under Sections 498A/406/506/34 of the Indian Penal Code, 1860 and Section 4 of the Dowry Prohibition Act, along with all consequential proceedings arising therefrom. 4. Learned APP for the State accepts notice on behalf of the State.
5. The petitioners are present before this Court. Respondent No.2 is also present and has been duly identified by her learned counsel as well as the Investigating Officer.
6. It is submitted that the present petition has been filed only by the mother-in-law (Petitioner No.1) and the brother-in-law (Petitioner No.2).
Learned counsel for the petitioners further submits that the husband of Respondent No.2 is absconding and has not approached this Court. It is further submitted that the present petition is confined only to the petitioners herein.

Learned counsel for the petitioners further submits that, in terms of the Settlement Agreement dated 07.05.2026, the entire settled amount has been paid to Respondent No.2. Today, a Demand Draft bearing No. 016189 for a sum of ₹50,000/- (Rupees Fifty Thousand only) has been handed over to Respondent No.2 in Court towards full and final settlement of all her claims.

On a query put by this Court, Respondent No.2, who has been duly identified by the Investigating Officer, states that she has entered into the Settlement Agreement dated 07.05.2026 of her own free will, without any force, coercion or undue influence. She further states that she has received the entire settled amount in terms of the settlement and has no objection if the FIR and all consequential proceedings are quashed qua the present petitioners only.

In view of the amicable settlement arrived at between the parties, and the statement made by Respondent No.2 that she has no objection to the quashing of the proceedings qua the present petitioners, no useful purpose would be served by continuing the criminal proceedings against them. is no legal impediment to quashing the FIR qua the present petitioners.

Accordingly, FIR No. 508/2019, registered at Police Station Harsh Vihar, under Sections 498A/406/506/34 IPC and Section 4 of the Dowry Prohibition Act, along with all consequential proceedings arising therefrom, is hereby quashed qua Petitioner No.1, Krishna Rani (mother-in-law), and Petitioner No.2, Jayanti Prasad (brother-in-law), only.
11. It is clarified that the present order shall not enure to the benefit of any other accused, including the husband, against whom the proceedings shall continue in accordance with law.
