Gopal Singh S/o Hukam Singh, Aged About 27 Years, R/o Ramgarh Jhutha, Village Panchayat Balad, Police Station Beawar Sadar, District Beawar (Raj.) (At Present Accused Petitioner Confined In Central Jail Ajmer). 3. Dashrath Singh @ Deepak S/o Hukam Singh, Aged About 25 Years, R/o Ramgarh Jhutha, Village Panchayat Balad, Police Station Beawar Sadar, District Beawar (Raj.) (At Present Accused Petitioner Confined In Central Jail Ajmer). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Jiya Ur Rahman For Respondent(s) : Mr. Jaiprakash Tiwari, PP with Mr. Gaurav Gupta, AGA HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 27/03/2026 1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.47/2026 registered at Police Station Jawaja, District Beawar for offences under Sections 189(2), 126(2), 115(2), 308(5) and 304(2) of BNS, 2023. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. [2026:RJ-JP:12947] (2 of 3) [CRLMB-4578/2026] 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The allegations against the petitioners are that they extorted money from the complainant and caused injuries to him. However, it is submitted that no specific role or overt act has been attributed to the present petitioners. It is further contended that no recovery has been made from their conscious possession. In contrast, a specific role has been assigned to the co-accused Narendra from whom recovery has also been effected. Petitioners are behind the bars since 05.01.2026 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Ghanshyam Singh S/o Hukam Singh, Gopal Singh S/o Hukam Singh & Dashrath Singh @ Deepak S/o Hukam Singh, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court for [2026:RJ-JP:12947] (3 of 3) [CRLMB-4578/2026] their appearance before the Court on all the dates till conclusion of the trial.
