2. By this application, the petitioners have raised the grievance that they can be arrested in connection with Katigorah P.S. Case No. 68/2026. When this application was filed, the petitioners did not know about the case where they can be implicated as an accused person, and as such, this Court had directed the learned Additional Public Prosecutor to get instructions from the katigorah Police Station as to whether any FIR is lodged against the present petitioners.
3. In compliance with the said direction, the learned Additional Public Prosecutor has submitted a report that no case is registered against the petitioners. However, the learned counsel for the petitioners submits that the petitioners are accused persons in connection with Katigorah P.S. Case No. 68/2026, wherein it was stated that the named accused persons along with others were connected in the offence mentioned therein. However, it is not seen that the petitioners were arrayed as accused persons in the said case.
4. Further, the requirement under Section 482 of the BNSS that a person can be released on anticipatory bail where he can show that he may be arrested on a accusation of having committed a non-bailable offence, is not attracted in the instant case. As such, this petition is closed with the liberty to the petitioners to file fresh application on arising of cause of action, if any.
5. Petition stands disposed of.
