CORAM: HON'BLE MS. JUSTICE MADHU JAIN O R D E R % 11.08.2026 1. This hearing has been done through hybrid mode. 2. By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the Petitioners seek quashing of FIR No. 54/2024, registered at Cyber Police Station, North, Delhi, for the offence punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), and all consequential proceedings arising therefrom, on the basis of the settlement arrived at between the parties. 3. Brief facts of the case are that Respondent No. 2 had approached the Petitioners in relation to services pertaining to immigration/overseas recruitment and, in connection therewith, made payments of Rs. 4,000/- on 21.10.2024 and Rs. 11,800/- on 05.11.2024. Certain disputes thereafter arose between the parties in relation to the said services, pursuant to which Respondent No. 2 lodged a complaint and the present FIR came to be registered on 14.12.2024. During the pendency of the investigation, the parties amicably resolved their disputes and entered into a Settlement Agreement dated 16.12.2024. 6. On a query made by this Court, Respondent No. 2, who has been identified by the Investigating Officer, states that he has amicably settled all his disputes with the Petitioners out of his own free will and without any force, coercion, undue influence or pressure. He further confirms that he has received the entire settlement amount and has no objection if the present FIR and all proceedings arising therefrom are quashed. 7. In view of the above, considering that the dispute between the parties is private in nature and has been amicably resolved, and Respondent No. 2 does not wish to pursue the criminal proceedings, no useful purpose would be served by continuing the proceedings arising from the present FIR. Continuation of the proceedings would only perpetuate the dispute despite the settlement arrived at between the parties. There is no legal impediment in quashing the FIR in question. 8. Accordingly, FIR No. 54/2024 registered at Cyber Police Station, North, Delhi, for the offence punishable under Section 318(4) of the BNS, along with all consequential proceedings emanating therefrom, is hereby This is a digitally signed order.
