1. Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs:- 10.1 that, the Hon’ble Court may kindly be pleased to Issue a writ of mandamus or appropriate direction directing the respondents to forthwith comply with and execute the order dated 21.11.2025 by removing the encroachment from government land bearing Khasra No. 109 included in 112/2, Village Kharhatta. c 10.2 that, the Hon’ble Court may further be pleased to direct the respondent authority for submission of a compliance report before this Hon’ble Court within a time-bound period. 10.3 that, the Hon’ble Court may further be pleased to fix the responsibility or erring officials for deliberate non-compliance of the lawful order. 10.4 that, the Hon’ble Court may pass any other
order or direction as this Hon’ble Court may deem fit in the interest of justice.

Learned counsel appearing for petitioner submits that private respondents No. 5 to 7 have encroached upon the government land and constructed Pakka House on it. He submits that the Tahsildar, Pandariya, District Kabeerdham / respondent No. 4 has passed three separate orders on the same day i.e. on 21.11.2025 for removal of aforesaid encroachment against respondents No. 5 to 7 under Section 248 (1) of the Chhattishgarh Land Revenue Code, 1959, despite that said order has not been complied with.

In reply, learned counsel appearing for the respondents No. 1 to 4/State, under instructions, would submit that three separate orders have been passed by that Tahsildar, Pandariya, Distirct – Kabirdham against respondents No. 5, 6 & 7 for removal of aforesaid encroachment, but the same have been challenged by each of them by filing Review being Revenue Case No. 201911080900059, Appeal Revenue Case Nos. 202601081100007 & 202601081100008, respectively before competent revenue authority, therefore, this petition has become infructuous.
4. I have heard learned counsel for the parties and perused the material placed on record.
5. Counsel for the petitioner has also conceded aforesaid facts. s Thus, since order to be complied with has been challenged by private respondents No. 5 to 7 under the law, therefore, this petition is dismissed as having become infructuous. No cost (s). Sd/- (Naresh Kumar Chandravanshi) Judge amit
