This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.19 10:56:27 +0530 2 Crime No.533/2025 registered at Police Station – Basna District-Mahasamund, for the offences punishable under Sections 318(4) read with Section 3(5) of BNS, 2023. 2. Case of the prosecution, in brief, is that on 31.12.2025, a written complaint was lodged by the complainant, namely Usat Kumar Pradhan, Branch Manager, Branch Pirda, District Cooperative Central Bank Raipur, CG. inter alia on the ground that inspection of Primary Agricultural Credit Cooperative Society, Pirda, Reg. No. 1233 was jointly conducted by Shri Lalit Singh, Nayab Tahsildar Pithora, Shri PS Vishal, Mandi Sub- Inspector and Akash Chauhan, Village Kotwar. According to the inquiry report, the applicant, who was posted as In Charge of Paddy Procurement Centre, and the owner of Malti Rice Mill, had allegedly kept 130 sacks of paddy, which were found to be old and of poor quality. Thus, the applicant and the owner of the rice mill were accused of allegedly disposing of the said paddy amounting to 130 sacks, acting contrary to the Paddy Procurement Policy of 2025-26, thereby causing a loss of Rs. 1,23,000/- to the Society and the Government. On the basis of the aforesaid complaint, FIR was registered against the applicant, hence, this bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that purposes of safe storage and handling of paddy in procurement centre Pirda, the applicant, being the In- Charge of the Paddy Procurement Centre, Pirda, had procured 3 300 sacks of chaff (badra) weighing 38.60 quintals amounting to Rs. 11,580/- from Mayuri Gold Krishak Beej Utpadak Kalyan Samiti, Jeeradabri, Tahsil Basna, District Mahasamund, CG. on 30.12.2025. The aforesaid purchase of chaff was made in the name of Sahkari Samiti Pirda and not in the name of the applicant. He further submits that no loss of Rs.1,23,000/- has been caused to the Society and the Government and no contrary action accordingly to the paddy Procurement Police of 2025- 2026 has been undertaken by the applicant. Further more there is no material relied upon by the prosecution to connect with the applicant, also investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel as well as learned counsel for the Objector opposes the prayer for grant of anticipatory bail and submits that applicant is having two previous criminal antecedent bearing crime No.353 of 2014 registered at police station Basna, District – Mahasamund (C.G.) for offence under Section 506 of IPC, and crime No.182 of 2015 for offence under Sections 182 of 2015 registered at Police Station Basna District – Mahasamund (C.G.) for offence under Sections 420, 409 of IPC, in both cases applicant has been acquitted from all charges. 5. I have heard learned counsel for the parties and perused the case diary. 4 6. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties, allegation levelled against the applicant and also considering the fact that applicant has two criminal antecedent and in both cases applicant has been acquitted from all charges, investigation and trial are likely to take time, therefore, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rohit Patel on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which 5 shall be verified by the trial Court.
