Case No. 147/2025. 3. An FIR was lodged on 01.12.2025 before the Officer-in-Charge, Bazaricheera Police Station to the effect that, on receipt of certain confidential information on 01.12.2025 about illegal smuggling of certain narcotic substances, the police started a naka checking. During the checking, one 12-wheeler vehicle bearing Registration No. NL-06A-7358, which was coming from Tripura towards Churaibari Naka Check-post, was stopped. The vehicle was intercepted, and the driver of the vehicle was detained for interrogation. During interrogation, he revealed that ganjas were being carried in the same vehicle. On search, police found 68 numbers of packets of suspected ganja in the vehicle, concealed inside the tarpaulin of the vehicle. The recovered ganja total weighed 376.62 kg. 4. On receipt of the FIR, police registered Special (NDPS) Case No. 32/2026, under the aforesaid sections. 5. The accused-applicant was arrested on the same date, and since then he has been behind the bars. 6. On completion of the investigation, the police filed the charge-sheet, vide Charge-Sheet No. 13/2026 dated 27.03.2026. The charge in the instant case has been framed on 19.05.2026, and the matter is now pending for evidence. 7. The learned counsel appearing for the accused-applicant submits that no witnesses have been examined till date after framing of the charge, and the accused-applicant has been languishing in jail since 01.12.2025. He submits that taking into account this long detention, the accused-applicant should be granted bail. Page No.# 3/3
8. The learned Addl.
PP, on the other hand, opposes the prayer for bail to the accused-applicant. 9. It is seen that charge-sheet has been filed on 27.03.2026, wherein eleven (11) PWs have been named by the prosecution in support of their case. The charge in the instant case has been framed on 19.05.2026. It is also seen that contraband, i.e., ganja, recovered from the vehicle driven by the accused-applicant is of 376.62 kg. 10. This Court has perused the TCR including the statements of the accused person as well as other witnesses recorded by the police. 11. Taking into account the facts of the case, as well as that the evidence is yet to be started, and considering the fact that charges have been framed only on 19.05.2026, this Court is not inclined to grant the benefit of bail to the accused- applicant in this case. 12. Accordingly, the instant bail application stands rejected and disposed of. JUDGE
