After arguing the matter for some time, learned counsel for the petitioner submitted that the petitioner would be satisfied if a direction is issued to the trial Court to ensure that the remaining witnesses are summoned in accordance with law and that the trial is concluded within a stipulated time frame. It was contended that the petitioner is facing prosecution in FIR No. 45/2018 registered at Police Station VOJ (now ACB-Jammu) for offences punishable under Sections 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act, Svt. 2006, and Section 120-B of the Ranbir Penal Code. Learned counsel further submitted that formal charges were framed on 28.10.2021 and that, although the case has remained pending since 2018, only 18 out of the total 21 prosecution witnesses have been examined. According to the petitioner, the orders passed by the trial Court indicate that no Sr. No. 18 2 effective efforts are being made to secure the attendance of the remaining witnesses. 2. Having considered the submissions made, and without expressing any opinion on whether sufficient efforts have in fact been made by the trial Court to procure the attendance of the witnesses or on the conduct of the petitioner in relation to the proceedings, this Court deems it appropriate to dispose of the petition with a direction to the trial Court to make all possible efforts to secure the presence of the remaining witnesses and to conclude the trial expeditiously in accordance with law. In view of the directions already issued by this Court on the administrative side regarding expeditious disposal of cases, no further orders are required. The petition is accordingly disposed of.
