1. This is first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.419/2025 registered at Police Chowki-Jalbandha, Police Station - Khairagarh District - Khairagarh-Chhuikhadan- Gandai (C.G.), for the offence punishable under Sections 304(2) read with Section 3(5) of Bhartiya Nyay Sanhita in short BNS, 2023.
2. The prosecution story in brief, is that the complainant namely VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.21 10:57:31 +0530
2 Suhaga Bai Verma made complaint to the concerned Police Station stating therein that at about 12:00 noon to on 21.08.2025, when she was cleaning the rice by sitting at her door, at that time one boy asked a glass of water and when she brought a glass of water at that time, he snatched the Mangalsutra, which was wear by her at ran away by the motorcycle, on the basis of said complaint FIR has been registered against the applicant.

Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in present case. He also submits that applicant has neither committed nor participated in any such act and he is in jail since 31.08.2025. He further submits that applicant is having nine criminal antecedents, and all are pending for their conclusion and co-accused has already been granted by learned trial Court, therefore, he prays for grant of regular bail to the applicant.

On the other hand, learned State counsel opposes the prayer for grant of bail and submits that applicant is having total 17 criminal antecedent, out of which only nine cases are mentioned by learned counsel for the applicant in the bail application at paragraph No.4(a), it appears that applicant is a habitual offender. Hence, the present applicant is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the fact and circumstances of the case,
submissions made by learned counsel for the parties and Furthermore, considering that a total of 17 criminal cases have been registered against the applicant in different police stations, it appears that the applicant is a habitual offender and has misused the liberty granted to him previously, thus this Court is of the view that it is not
3 a fit case to release the applicant on bail.

Accordingly, the bail application of the applicant namely Maksudan Sahu, involved in Crime No. 419/2025 registered at Police Chowki- Jalbandha, Police Station - Khairagarh District - Khairagarh- Chhuikhadan-Gandai (C.G.), for the offence punishable under Sections 304(2) read with Section 3(5) of Bhartiya Nyay Sanhita in short BNS, 2023, is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
