JUSTICE SHAMIMA JAHAN ORDER Date : 30.09.2026 Heard Mr. K. Thakur, learned Counsel appearing on behalf of Mr. D. Medhi, learned Counsel for the petitioner and Ms. SH Bora, learned Additional Public Prosecutor for the State. 2. By this application, the petitioner has prayed for bail in connection with Dispur PS Case No. 467/2026 registered under Sections 178/179/180/61(2) of BNS, 2023. The FIR in connection with which the petitioner was arrested on 02.07.2026 was lodged by the police personnel of Dispur Police Station stating inter alia that on information that fake currency notes were transported by a vehicle, the informant along with other staff intercepted the said vehicle and arrested the occupants thereof amongst whom one is the petitioner. The informant further stated that the vehicle was searched and a black bag pack was found with fake Indian currency notes amounting to Rs. 2,56,000/- from the possession of the said occupants. 3. The learned Counsel for the petitioner submits that fake Indian currency notes were recovered from both the arrestees including the petitioner and that it is not stated that it was only from the petitioner. He further submits that the petitioner has been inside the jail for quite some time and as such bail be granted to him. 4. On the other hand, Ms. SH Bora, learned Additional Public Prosecutor for the State, on the perusal of the Case Diary submits that the petitioner along with another was found in the vehicle and they were found carrying fake Indian currency notes amounting to Rs. 2,56,000/- and the seizure list also shows that Page No.# 3/3 the notes were recovered from the petitioner and another. 5. Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that the petitioner was caught transporting the fake Indian currency notes along with his companion and also due to the fact that charge sheet has been submitted against the petitioner and another and the case is yet to be committed to the concerned Court, this Court does not deem it fit to enlarge the petitioner on bail at this stage. 6. Petition is dismissed. JUDGE Comparing Assistant
