2/02.06.2026 Heard Mr. Abhishek Singh, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Sakchi P.S. Case No. 32 of 2022.
It has been alleged that a protest was organized against the ban on hizab in the state of Karnataka and in course of which and several persons had unlawfully assembled without the permission of the administration and had raised provocative and communally sensitive slogans, thereby, disturbing the public peace and tranquility as well as communal harmony. It has also been alleged that the police personnel were obstructed in discharging their official duties by the mob.
Submission has been advanced by the learned counsel for the petitioner that the allegations are general and omnibus in nature. It has further been submitted that the petitioner does not have any criminal antecedent.
Learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner.
Regard being had to the fact that the petitioner has been alleged to be one of the members of the mob which had created an unruly situation by the provocative slogans and had also prevented the administration from discharging their official duty, I am inclined to extend the privilege of anticipatory bail to the petitioner.
Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction
2026:JHHC:16011 of learned C.J.M., Jamshedpur in connection with Sakchi P.S. Case No. 32 of 2022, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
This application stands allowed.
