Heard the counsel for the petitioner and the A.G.A. for the State. The present petition has been filed challenging the First Information Report dated 20.9.2026 registered as Case Crime No.0413 of 2026, under Sections 137(2), 87 B.N.S., 2023, Police Station Aurai, District Bhadohi. The recitals in the first information report raise allegations which constitute an offence. However, the records also disclose that the petitioner is minor and below 16 years of age. In case, the petitioner is a juvenile and below 16 years of age, he is to be governed by Juvenile Justice (Care and Protection of Children) Act, 2015. No interim protection is required as the petitioner is protected by Section 10 of the Juvenile Justice (Care and Protection of Children) Act, 2015 which prohibits a juvenile being lodged either in a jail or be placed in a police lockup.
