JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.8775/2022, pending before the CJM Rural Court, Bengaluru Rural, Bengaluru, for the offences punishable under Sections 498A r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family court in O.S.No.346/2021 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking quashment of the proceedings by permitting them to compound the offences. They submit that the parties have settled the dispute and the couple had obtained a decree of dissolution of marriage in the year 2023. They also submit that petitioner No.1 – accused No.1 – husband of the complainant is no more as he has died on 25.12.2025 and other parties are before this Court. The parties have filed photocopies of the death certificate of petitioner No.1 - accused No.1, the order sheet of - 4 - HC-KAR NC: 2026:KHC:9853 CRL.P No. 2639 of 2023 the family Court and the memorandum of settlement under Section 89 of the CPC r/w. Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, before this Court. 3. The memorandum of settlement reads as follows: “4. The defendant has agreed to pay a sum of Rs.1,00,000/- (Rupees One Lakh Only) to the plaintiff herein towards all her claims of maintenance / permanent alimony as full and final settlement and the said amount will be paid to the plaintiff at the time of reporting settlement In Crl.P. No.2639/2023 before the Hon'ble High Court of Karnataka, Bengaluru. 5. The defendant has agreed to return 3 gold rings, one gold chain and one motor bike belonging to the plaintiff to her at the time of reporting this settlement. 6. Both parties state that apart from the above they have agreed to exchange their household articles before reporting this settlement. 7. In view of this settlement both parties have agreed to co-operate in closing / quashing the proceedings in C.C. No.8775/2022 pending before Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru filed under Section 498-A of IPC R/W Section 3 & 4 of D.P. Act. With regard to the said criminal case the defendant has filed Crl. P. No.2639/2023 for quashing the proceedings in C.C. No.8775/2022. In view of this settlement both parties have agreed to co-operate in closing the proceedings. 8. The defendant has agreed to withdraw O.S. No.1236/2020 pending before VII Addl.
