Shakir S/o Ashraf, Aged About 23 Years, R/o Bich Ka Bas, Odhara, Police Station Kishangarh Bas, District Khairthal- Tijara, Raj. (At Present Confined In Sub Jail Kishangarh Bas) ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Sumer Singh Ola For Respondent(s) : Mr. Rajesh Choudhary, GA-cum-AAG with Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 15/01/2026 1. The petitioners have filed this bail application under Section 483 of BNSS in FIR No.321/2025 registered at Police Station Kishangarh Bas, District Khairthal-Tijara for offences under Sections 189(2), 115(2), 126(2), 303(2) and 351(2) of BNS, 2023.. 2. Heard learned counsel for the petitioners as well as learned Government Advocate-cum-Additional Advocate General and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further [2026:RJ-JP:1701] (2 of 3) [CRLMB-709/2026] submits that petitioners and complainant are neighbours and that the present incident arose out of a trivial dispute. He again submits that a cross-FIR has been lodged in the present matter, in which injuries were inflicted upon the present petitioners. As per the medical report, the injuries caused to Sadiq are reported to be dangerous to life; however, the same are not attributed to the present petitioners. He submits that injuries inflicted upon another injured Ruksina is simple in nature and caused by blunt weapon. He contends that co-accused Aasmohammed and Shokin were released on bail by this Court vide order dated 07.01.2026. Charge-sheet has already been filed. Petitioners are behind the bars since 01.10.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of parity with other co-accused, hence, the bail application of the petitioners may be allowed. 4. Learned Government Advocate-cum-Additional Advocate General has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Sahil S/o Arshad and Shakir S/o Ashraf, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of [2026:RJ-JP:1701] (3 of 3) [CRLMB-709/2026] the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
